A lawsuit against Governor Tony Evers is asking the court to toss the face mask mandate.
Three Wisconsin residents filed the lawsuit in Polk County Court represented by the Wisconsin Institute for Law and Liberty. More than taking issue with the mask mandate itself, the lawsuit argues Evers didn’t have the power to declare a second public health emergency on the same pandemic after the original and maximum 60 day order expired. The lawsuit contends that at that point, only the legislature can extend a public health emergency.
