A judge is refusing to set-aside a 40-year-old murder case in Polk County.
The judge yesterday refused Mary Bailey’s request to dismiss the charges against her. Prosecutors claim Bailey shot and killed Yvonne Menke outside of her apartment St. Croix Falls back in 1985. The two were apparently dating the same man. Bailey says the case doesn’t have any facts that point to her as the murderer.
Bailey remains in jail on 300 thousand-dollars bond, and is due back in court in March.
