Review Of Officer Involved Death Released

The review of an incident dating back to December has been completed and the following was released by the ECPD:

On Wednesday November 3, 2021 the Eau Claire Police Department was involved in the fatal shooting
of a man who had stabbed a woman and was armed with a knife inside a residence on the west side of Eau Claire. The subject, who was pronounced deceased at the scene, was identified as LeKenneth Q. Miller DOB 2/14/1991.


Pursuant to Wisconsin State Statute and Eau Claire Police Department policy, the Wisconsin Department of Justice – Division of Criminal Investigations completed a criminal investigation. On December 28, 2021, Eau Claire County District Attorney Peter Rindal provided a written summary based on the investigation completed by the Wisconsin Department of Justice – Division of Criminal Investigations. In this summary, District Attorney Peter Rindal advised that Officer O’Neill’s use of force was justified as a reasonable act of self-defense and defense of others.

The Eau Claire Police Department has concluded an Administrative Review of the incident. The purpose of conducting the Administrative Review is to determine policy adherence during critical incidents. It has been determined that the decision making and actions of Officer O’Neill were appropriate, necessary, and compliant with Eau Claire Police Department policy.
