Health Leaders Given Authority After Gavel Drops in WI Court

Public health orders can be issued in Wisconsin without approval by elected officials.

The state Supreme Court issued its 4-3 ruling yesterday in a Dane County case.  The four majority ruling justices ruled that current state law allows health officials to have authority to issue orders without prior approval of elected bodies.

Dane County Executive Joe Parisi says the ruling is a “win.”   As a result of the ruling, Dane County Board Supervisor Jeff Weigand is calling on state lawmakers to enact a law to require that health officials first get approval from elected officials before unilaterally mandating public health orders.
